Terms & Conditions
Welcome to GoRide, a cutting-edge platform connecting users with various services, designed to enhance your convenience and lifestyle. GoRide aims to provide an efficient and seamless experience, and by using the GoRide application ("the App"), You are consenting to be bound by these T&Cs. It is essential to thoroughly review and understand the following T&Cs, as they govern your use of the App. Please refrain from using the App if you do not agree with any part of these T&Cs.
1. User Eligibility
To utilize GoRide, you must be at least 18 years old and capable of entering into a legally binding agreement. By accessing and using the App, you confirm that you meet these eligibility criteria.
2. User Accounts
Access to GoRide's services requires the creation of a user account. Users are responsible for providing accurate and complete information during the registration process. Safeguard your account credentials, and immediately report any unauthorized access to GoRide.
3. Service Description
GoRide operates as a comprehensive platform connecting users with diverse services. Users have the ability to request various services through the user-friendly interface of the App.
5. GoRide Rewards Loyalty Programme and Promotions for Consumers
If you are a Consumer using the Application, you will automatically be a member of the loyalty programme named “GoRideRewards Loyalty Programme” operated by GoRide and/or its affiliate companies.
The terms of the GoRideRewards Loyalty Programme will be governed by the GoRidePay Terms of Service.
From time to time, GoRide may run marketing and promotional campaigns which offer voucher codes, discounts, subscription plans, or other promotional offers to be used on the Platforms (“Vouchers”). Vouchers are subject to validity periods, redemption periods, limits and/or availability. Vouchers may not be valid when used in conjunction with other promotions, discounts, or other vouchers. Additional terms and conditions may apply to Vouchers. Unless otherwise stated, Vouchers can only be used on our Platforms. Vouchers are non-transferable, non-exchangeable, and non-refundable and cannot be exchanged for cash. GoRide reserves the right to withdraw, amend and/or alter any part of the terms and conditions of the promotions and subscriptions at any time without any prior notice. GoRide reserves the right to void, discontinue or disqualify you from any promotion or subscription plan without prior notice to you, in the event you breach any part of these Terms of Service.
6. Ratings
Consumers and Partners may be allowed to rate each other in respect of Solutions provided.
Every rating will be automatically logged onto GoRide’s system and GoRide may analyze all ratings received. GoRide may take all appropriate actions including suspending your use of the Service without any notice or compensation to you.
7. Pricing and Payment
7.1 Payment Terms for Users
Users agree to pay the fees presented on the App for the requested services. Payment methods, including credit cards, debit cards, GoRide Wallet, Cash on Delivery (COD), and BML Payment Gateway, are processed securely through the App. Any payment made through these methods is non-refundable and irrevocable.
If the tipping feature is available, consumers may have the option to pre-set a default “tip” amount when registering for the service. This tip will automatically be included in the Consumer Charges after the service has been provided and given to the Partners unless changed or removed by the consumer.
7.2 Payment Terms for Partners (Drivers-partners / Delivery-partners)
GoRide charges a fee for your use of the Service ("Service Fee"). The Service Fee may be up to 20% of the Consumer Charges unless otherwise communicated and accepted by you before commencing provision of the Solutions. The Service Fees are payable immediately and are non-refundable.
GoRide may administer and act as your collection agent to pay you the total amount of Consumer Charges due to you in respect of your provision of the Solution.
GoRide retains the right to suspend the processing of any transaction where it reasonably believes the transaction may be fraudulent, illegal, or involves any criminal activity or where you and/or the Consumer have breached any of the Terms in this Agreement. In such an event, you shall not hold GoRide liable for any withholding of, delay in, suspension, forfeiture, or cancellation of any payment(s) to you.
GoRide may, at its sole discretion, make promotional offers with different features and rates on the Solutions to any Consumer whereby these promotional offers shall accordingly be honored by you. GoRide may change the Service Fee at any time at its sole discretion.
7.3 Payment Methods for Partners
GoRide shall administer payments to you and from you by way of a wallet system (the “Driver’s Cash Balance”). You must ensure your Cash Balance is not negative at all times. Your earnings will be displayed in the Driver’s Cash Balance in the Application and may be withdrawn by you to your designated bank account, or where available, to your Driver GoRidePay Wallet, or to such other recipient accounts as are made available in the Application, provided always, your Cash Balance does not fall below MVR 15.
In addition to your Driver’s Cash Balance, you must also maintain with GoRide a Driver’s Credit Balance. The Driver’s Credit Balance comprises a pre-payment to GoRide by you of commissions and other fees and charges applicable under these Terms of Service. You must at all times maintain a minimum credit balance (“Minimum Balance”) in your Driver’s Credit Balance in order for you to use the Service. The amount of such Minimum Balance shall be prescribed by GoRide, and shall be notified to you via the Application. It may be changed at any time at GoRide’s sole discretion.
You may add funds (“Credits”) to your Driver’s Credit Balance to fulfill the Minimum Balance requirement. The maximum balance you may hold in the Driver’s Cash Balance at any time is MVR 5,000.00. Balance may be added in any manner prescribed by GoRide from time to time (such as cash reload and credit/debit card payments or transfer from your Driver Cash Balance).
Funds in the Driver’s Credit Balance are not redeemable for cash and cannot be refunded. They cannot be resold, exchanged, or transferred for value under any circumstances. The funds shall not be regarded, construed, or used as valuable or exchangeable instruments under any circumstances. You will not receive interest or other earnings on your Credits. GoRide may receive interest on amounts that GoRide holds on your behalf. You agree to assign your rights to GoRide for any interest derived from your Credits.
8. Cancellations and Refunds
8.1 Cancellation
8.1.1 For Partners:
The Consumers rely on you for delivery or provision of the Solutions. You agree that high and/or frequent cancellation rates or ignoring the Consumers’ bookings will impair the Consumers’ experience and negatively impact the reputation and branding of GoRide.
While you may cancel a booking, the cancellation shall be based on acceptable cancellation reasons as shown in the Application. GoRide reserves the right to amend the acceptable cancellation reasons from time to time. A cancellation that is not based on one of the acceptable reasons or ignoring a booking may be counted in determining if your access to the Service will be temporarily restricted.
8.1.2 For Consumers:
You may cancel your request for transportation services at any time before you commence your ride with the Partner that has been matched with you by the Service.
If you decide to cancel your booking or do not show up at the designated location, you may be charged a Cancellation Fee or such other Cancellation Fee as GoRide may notify from time to time via the Cancellation Policy on GoRide’s website.
If you feel you were incorrectly charged a Cancellation Fee, you may contact GoRide via the Help Center on GoRide’s website for assistance. GoRide reserves its absolute discretion to any refunds to you and such refunds may be credited to the payment card you used for the journey, or the GoRidePay Credits or such other method as is deemed reasonable by GoRide, for cash payments.
9. Conduct Guidelines
Users are expected to treat their service partners and fellow users with respect and courtesy. Prohibited behavior includes discrimination, harassment, and any violations of applicable laws.
10. Privacy Policy
GoRide collects and processes user data in accordance with its Privacy Policy, compliant with privacy laws. By using the App, you consent to the collection and use of your information as outlined in the Privacy Policy.
11. Intellectual Property
GoRide retains ownership of all intellectual property related to the App. Users are granted a limited, non-exclusive, revocable license to use the App.
12. Limitation of Liability
GoRide is not liable for direct, indirect, incidental, or consequential damages arising from App use or services provided, to the extent permitted by law.
13. Governing Law
These terms are governed by and construed in accordance with the laws.
14. Refund Process
14.1 Refund Process Timelines
Subject to any specific refund conditions stated herein, routine refund process via BML will take 7-10 working days to process after validation from GoRide and is subject to the general banking process(es), timeline(s), and/or any delay(s).
Reversal of any amount to Customer’s credit balance will take 2-3 working days to process after validation from GoRide.
In case of public holidays, maintenance activities, or extraordinary circumstances, refund processing may require and take a longer duration. If any unreasonable delays occur in the processing of the refund, GoRide will inform Customer via call/SMS/email as may be decided by GoRide.
Refund will not be provided for claims that are beyond the control of GoRide, where the Customer has consented or facilitated a transaction by sharing information received to the Customer for verification or otherwise, and which cannot be validated by GoRide.
14.2 Wallet Deposit and Transfer
If a Customer deposits funds into their wallet and subsequently transfers that amount to another individual who then requests a withdrawal, GoRide will deduct BML commission as per BML's payment terms and conditions.
14.3 Payment Types
GoRide may process refunds using various payment types, including:
- GoRide Wallet
- Cash on Delivery (COD)
- BML Payment Gateway
15. Governing Law
These terms are governed by and construed in accordance with the laws.
16. Modifications
GoRide reserves the right to modify these terms at any time. Users will be notified of any changes.
17. License Grant and Restrictions
GoRide and its licensors, where applicable, grant you a revocable, non-exclusive, non-transferable, limited license to use and access the Application and/or the Software to use the Service, subject to the terms and conditions of this Agreement. All rights not expressly granted to you are reserved by GoRide and its licensors.
You shall not:
- post, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner of such proprietary rights; or
- remove any copyright, trademark or other proprietary rights notices contained on the Application or Platform.
As a user of the GoRide platform, you agree to adhere to the following responsibilities:
- Retaining Transaction Records: It is recommended that you, as the Cardholder, retain a copy of your transaction records for your reference. This includes keeping records of payments made for services rendered through the GoRide application.
- Compliance with Policies and Rules: You are expected to familiarize yourself with and abide by the Policies and Rules outlined by GoRide. These policies govern your interactions and transactions on the platform, ensuring a safe and reliable experience for all users.
By accepting these terms and conditions, you acknowledge and agree to fulfill the above responsibilities.
